Web module Employment Relationship Assessment from the Dutch authorities available in a pilot phase

Hiring a self-employed professional comes with rules. To clarify these rules, the government has developed an anonymous, online questionnaire. Filling out all the questions in the tool will produce one of the following results:

• Indication that the assignment can be performed by a self-employed professional, outside employment.
• Indication that the employment relationship is actually a form of employment.
• The replies do not make clear what the work relation is in this case.

No legal decision

During the pilot phase, the outcome of the online tool is merely an indication, not a legal decision. You cannot make any legal claims based on the outcome. But the outcome can help you decide how to have the assignment carried out.

Who can use the online tool?

Employers and procurers in the Netherlands who set out assignments to contractors in the Netherlands.

The online tool is not for contractors or sector representatives, unless they act in the role of procurer. If you enter into an agreement with a legal entity, the online tool will not give a result. Nor if you act as an intermediary or mediator.

About the tool

The Webmodule Beoordeling Arbeidsrelatie tool will first be available as a pilot. The pilot phase will help to improve the tool. The government will enter into talks with several sector organisations to discuss the effectivity and user-friendliness of the tool.

Help to improve

The online tool will be evaluated before the decision to go ahead is made. To gather information for this evaluation, you will be asked to contribute to a survey on how the tool works before you see the result. Your user experience will help to decide if the tool will be implemented.

Using the online tool

To start the questionnaire, open the online tool (in Dutch).

You cannot save your replies between questions. Make sure you have enough time to fill out all questions in one go. If you have to pause the questionnaire, don’t close the window. You can resume filling out the tool later on. If you close the window (by clicking the x in the top right hand corner), the session will be terminated and you will have to start over.
